Introduction

Welcome to AirCheckIn. These Terms of Service ("Terms") govern your access to and use of the AirCheckIn platform, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

These Terms are established in compliance with Moroccan law, including Law n°09-08 on the protection of individuals with regard to the processing of personal data, and Law n°80.14 governing tourist accommodation.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

1. Definitions

  • "Service" refers to the AirCheckIn platform, website, and all related services.
  • "Host" refers to Airbnb property owners or managers who use our Service.
  • "Guest" refers to individuals who stay at Host properties and complete verification.
  • "Verification" refers to the process of collecting and validating guest identity documents.
  • "We," "Us," or "Our" refers to AirCheckIn.
  • "You" or "Your" refers to the user of our Service.

2. Eligibility and Account Registration

2.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use our Service. By using the Service, you represent and warrant that you meet these requirements.

2.2 Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and update your information to keep it accurate and current.
  • Keep your account credentials confidential and secure.
  • Notify us immediately of any unauthorized access or security breach.
  • Accept responsibility for all activities that occur under your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

3. Description of Service

AirCheckIn provides a platform that enables Hosts to collect and verify guest identity documents in compliance with Moroccan regulations. Our Service includes:

  • Generation and distribution of secure verification links.
  • Collection and secure storage of guest identity documents.
  • Property and reservation management tools.
  • Email notifications and reminders.
  • Dashboard for tracking verification status.
  • Compliance reporting and data export capabilities.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

4. User Obligations

4.1 Lawful Use

You agree to:

  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Comply with all applicable local, national, and international laws and regulations.
  • Comply with Moroccan regulations regarding guest registration and identification.

4.2 Prohibited Activities

You agree NOT to:

  • Use the Service for any fraudulent or illegal purpose.
  • Upload false, misleading, or fraudulent information.
  • Impersonate any person or entity.
  • Interfere with or disrupt the Service or servers.
  • Attempt to gain unauthorized access to any part of the Service.
  • Collect or harvest personal information of other users.
  • Use automated systems (bots, scrapers) without permission.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Share your account credentials with others.

4.3 Data Accuracy

Hosts are responsible for ensuring that all guest information and verification requests are accurate and legitimate. You agree to use the Service only for verifying guests who have actual reservations at your properties.

5. Subscription and Payment

5.1 Subscription Plans

AirCheckIn offers a monthly subscription plan at 200 MAD per month. New users receive a 7-day free trial. After the trial period, your subscription will automatically renew monthly unless cancelled.

5.2 Payment Terms

  • All fees are in Moroccan Dirham (MAD) and are non-refundable.
  • Payment is processed through Stripe, our third-party payment processor.
  • You authorize us to charge your payment method on a recurring monthly basis.
  • You are responsible for providing accurate and current payment information.
  • We reserve the right to change subscription fees with 30 days' notice.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

  • Your access will continue until the end of your current billing period.
  • No refunds will be provided for partial months or unused service.
  • Your data will be retained according to our data retention policy.

5.4 Failed Payments

If a payment fails, we will attempt to process it again. If payment continues to fail, your account may be suspended or terminated after a grace period.

6. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

6.1 Compliance with Law n°09-08

The processing of personal data by AirCheckIn is governed by Moroccan Law n°09-08 on the protection of individuals with regard to the processing of personal data. Personal data is processed only for the specific, explicit, and legitimate purposes described in our Privacy Policy, and is not processed further in any manner incompatible with those purposes.

6.2 Consent to Processing of Personal Data

By creating an account and using the Service, you provide your free, specific, informed, and unambiguous consent to the processing of your personal data as described in the Privacy Policy. Where you are a Host, you also acknowledge your role as a data controller with respect to your guests' personal data processed through the Service.

6.3 Host Responsibilities as Data Controller

As a Host using AirCheckIn to collect and process guest personal data, you act as a data controller within the meaning of Law n°09-08. You are responsible for:

  • Obtaining the prior, free, specific, and informed consent of your guests for the collection and processing of their personal data, or establishing another lawful basis as permitted by Law n°09-08.
  • Informing guests, at the time of data collection, of the identity of the data controller, the purposes of processing, their rights under Law n°09-08, and any third parties to whom data may be transferred.
  • Using guest personal data only for the purpose of complying with Moroccan Law n°80.14 (guest registration and Bulletin Individuel d'Hébergement) and for no other incompatible purpose.
  • Not sharing guest data with unauthorized third parties.
  • Responding promptly to any request from a guest exercising their rights under Law n°09-08 (right of access, rectification, erasure, or objection).
  • Complying with all applicable data protection laws and regulations, including Law n°09-08.

6.4 Data Security

We implement appropriate administrative, technical, and organizational security measures as required by Article 23 of Law n°09-08 to protect your data. However, no system is completely secure, and we cannot guarantee absolute security. You agree to implement appropriate security measures on your side and to notify us immediately if you become aware of any unauthorized access to or disclosure of personal data.

6.5 Data Subject Rights

Individuals whose data is processed through the Service retain all rights afforded to them under Law n°09-08, including the right of access, rectification, erasure, and objection. Requests from data subjects to exercise their rights should be directed to privacy@aircheckin.co. As a Host, you agree to cooperate with us in responding to any such requests that relate to data you have submitted through the Service.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including all content, features, functionality, software, code, designs, logos, and trademarks, is owned by AirCheckIn and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

7.2 User Content

You retain ownership of any content, data, or documents you upload to the Service. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.

7.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation to you.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We disclaim all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties regarding the accuracy, reliability, or availability of the Service.
  • Warranties that the Service will be uninterrupted, secure, or error-free.
  • Warranties regarding the results obtained from using the Service.

We do not warrant that the Service will meet your requirements or that any defects will be corrected. Your use of the Service is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by law, AirCheckIn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service.
  • Any unauthorized access to or use of our servers or your data.
  • Any interruption or cessation of the Service.
  • Any bugs, viruses, or malicious code transmitted through the Service.
  • Any errors or omissions in content or data.
  • Any conduct or content of third parties using the Service.

In no event shall our total liability to you for all damages exceed the amount you paid to us in the 12 months preceding the claim, or 1,000 MAD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless AirCheckIn, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of another person or entity.
  • Your violation of any applicable laws or regulations.
  • Any content or data you upload or submit through the Service.

11. Compliance with Moroccan Regulations

AirCheckIn is designed to help Hosts comply with Moroccan regulations regarding guest registration and identification, including Law n°80.14 and Law n°09-08 on personal data protection. However:

  • You are solely responsible for ensuring your use of the Service complies with all applicable laws.
  • We do not provide legal advice regarding compliance requirements.
  • You should consult with legal counsel regarding your specific obligations under Law n°09-08 and any other applicable regulations.
  • Changes in regulations may require adjustments to how you use the Service.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting support or through your account settings.

12.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately. Grounds for termination include but are not limited to:

  • Violation of these Terms.
  • Fraudulent, abusive, or illegal activity.
  • Non-payment of subscription fees.
  • Extended periods of inactivity.

12.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service will immediately cease.
  • We may delete your account and data in accordance with our data retention policy.
  • Sections of these Terms that by their nature should survive will remain in effect.

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be submitted to the competent courts of Morocco.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AirCheckIn regarding the Service.

14.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

14.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.4 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

14.5 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms at any time without restriction.

14.6 Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party websites or services.
